A former Battle Ground Academy student injured last year during a baseball game has filed a lawsuit against his alma mater, claiming $3 million in damages. Named as defendants in the complaint are BGA, the TSSAA, and three high school umpires listed as John Does.According to the court filing, a copy of which is available at this link, BGA pitcher Cason McInturff was sitting outside of the dugout with an assistant coach during the team’s at-bat when a live ball struck him in the head. Later, at the request of his parents, he was taken to the emergency room and transferred to Vanderbilt Hospital where he spent the next six days. McInturff, who had a previous head injury in 2000 of which the complaint claims the school was aware, suffered a skull fracture and frontal lobe contusion in addition to hemorrhaging. The complaint alleges that all the defendants were negligent in delaying medical care and by allowing the player to be outside the dugout during the game. Susan Minor, director of marketing communications at BGA, told NashvillePost.com today that the school has not yet been served with the lawsuit. "We know nothing about it," she said.Officials from the TSSAA could not be reached for comment, as the office was empty due to tonight’s BlueCross Bowl at MTSU.
