English Only suit dismissed

Honduran immigrant plaintiff says appeal likely

12-03-2008 5:59 PM

The English Only referendum is going forward. Davidson County Chancellor Claudia Bonnyman dismissed a lawsuit Wednesday seeking to keep the English Only charter special election from taking place on Jan. 22. A Honduran immigrant had challenged the constitutionality of the charter amendment proposal.

Bonnyman ruled that her court did not have jurisdiction on the matter because the issue was not ripe until after the proposal is approved. Councilman Eric Crafton, the leader of English Only movement, arrived 15 minutes late to the hearing.

He said afterwards, "Obviously, we agree with this ruling. Hopefully this is the last we hear from the anti-English people."

The plaintiff, Rosa Quinteros, said through her attorney that an appeal was likely.
