The United States Court of Appeals for the Sixth Circuit has denied State Sen. Rosalind Kurita's request for a temporary restraining order and injunction to halt the election for the 22nd State Senate District.
In making their decision, the three-judge panel of the court said that "Kurita has not shown a likelihood of success to justify an injunction. Specifically, we cannot find a likelihood that Kurita will succeed in showing a property right in the primary voter election results or her initial certification and adopt the reasoning of the district court on this issue."
What this means is that the election will move forward and that Kurita's write-in campaign continues. She will have a chance to make her argument at the Sixth Circuit Court, based in Cincinnati, but a date for that hearing has not been set.
